Expectant Mother Parking in Florida:
Everything You Need to Know

  • Florida Expectant Mother Parking Laws

    • Effective July 1, 2025, Florida law (SB 462 / Section 320.0849) allows the FLHSMV to issue temporary handicap parking permit for pregnancy to expectant mothers.
    • The qualifying condition is pregnancy - any expectant mother is eligible for this permit.
    • A licensed physician (MD or DO) under Chapter 458 or 459, Florida Statutes, must certify the applicant's pregnancy on Form HSMV 83040.
    • The permit is valid for up to 1 year from the date of issuance.
    • The permit allows expectant mothers to park in any accessible (disabled) parking space designated under Section 553.5041.
    • The placard must be hung from the rearview mirror when parked in a designated accessible space.
    • It is unlawful to obstruct curb cuts, accessible parking aisles, or accessible paths to parking spaces.
    • Misuse of the permit may result in fines and permit revocation.
    • The Florida DMV does not automatically issue the placard. Applicants must submit their paperwork to their local Tax Collector or license plate agency.

    What's on Form HSMV 83040?

    The application includes three sections:

    • Section 1: Completed and signed by the applicant requesting the permit

  • Renewal & Replacement

    Expectant Mother Permits

    • Valid for up to 1 year from the date of issuance.
    • The permit is designed to cover your pregnancy and postpartum recovery period.
    • Since the permit is tied to pregnancy, renewal would require a new Form HSMV 83040 with updated physician certification.

Replacing a Lost, Stolen, or Damaged Placard

    • Contact your local Tax Collector's office or license plate agency.
    • You may need to complete a replacement affidavit.
    • Bring your valid Florida driver's license or state-issued ID card.

    Turnaround Time

Most Florida DMV offices issue the physical placard the same day once paperwork is complete; mail-in requests typically arrive within 1-3 weeks (check your county office for exact timing).

  • How do I apply for a handicap parking permit for pregnancy in Florida?

To apply through ParkingMD, start by completing a quick online evaluation with a licensed Florida physician from the comfort of your home. If approved, your signed Form HSMV 83040 will be delivered via email within 24-48 hours. Once you receive the form, submit it along with your Florida driver's license or ID to your local Tax Collector's office or DMV to receive your parking permit.

  • What's the difference between an expectant mother permit and a disability parking permit?

Both permits allow you to park in accessible (disabled) parking spaces, but they have different eligibility requirements. The expectant mother permit (HSMV 83040) requires only physician certification of pregnancy. The disability parking permit (HSMV 83039) requires certification of a qualifying mobility impairment or medical condition. Expectant mother permits are valid for up to 1 year; temporary disability permits are valid for up to 6 months.

  • Can my partner or family member use my expectant mother permit?

The permit can be used in any vehicle transporting the expectant mother. However, the permit is issued specifically to the pregnant woman and should only be used when she is being transported in that vehicle. Misuse of the permit may result in fines and revocation.

  • Will other states recognize my Florida expectant mother parking permit?

Florida's expectant mother parking permit is a state-specific program created under Section 320.0849, Florida Statutes. Other states may not recognize this permit since it differs from standard disability placards. If traveling out of state, check local parking regulations.

  • Can I still use my permit after giving birth?

Yes. The expectant mother parking permit is valid for up to 1 year from the date of issuance. As long as you're within that 12-month period, you can continue using the permit during your postpartum recovery.
